The rule qualifies a business as a joint employer if it meets the following four-factor test and exercises the power to:<\/p>\n\n\n\n<ul><li>hire or fire the employee<\/li><li>supervise and control employee\u2019s schedule or conditions of employment<\/li><li>determine employee\u2019s rate and method of pay<\/li><li>maintain employee\u2019s employment records<\/li><\/ul>\n\n\n\n<p>Additional factors may be used to determine joint employer status, but only if they indicate the potential joint employer\u2019s:<\/p>\n\n\n\n<ul><li>Significant control over the terms and conditions of the employee\u2019s work, or<\/li><li>Direct or indirect actions in the interest of the business in relation to the employee<\/li><\/ul>\n\n\n\n<p>Factors that would NOT determine joint employer status include:<\/p>\n\n\n\n<ul><li>Employee\u2019s economic dependence on the business<\/li><li>Business\u2019s ability, power or reserved contractual right to act in relation to the employee<\/li><li>Business model (for example, operating as a franchisor)<\/li><\/ul>\n\n\n\n<p>The rule provides a number of hypothetical examples to illustrate joint employer status.<\/p>\n\n\n\n<p>The public will have 60 days from the date of the rule\u2019s publication in the Federal Register (which has yet to be made) to comment on the proposed rule.<\/p>\n\n\n\n<p>For more information, see the&nbsp;<a href=\"https:\/\/www.dol.gov\/whd\/flsa\/jointemployment2019\/\" target=\"_blank\" rel=\"noreferrer noopener\">USDOL website<\/a>, the&nbsp;<a href=\"https:\/\/www.dol.gov\/whd\/flsa\/jointemployment2019\/joint-employment_factsheet.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">USDOL Fact Sheet&nbsp;<\/a>or the&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/04\/09\/2019-06500\/joint-employer-status-under-the-fair-labor-standards-act\" target=\"_blank\" rel=\"noreferrer noopener\">Notice of Proposed Rulemaking<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On April 1st, 2019, the U.S. Department of Labor (USDOL) announced a proposed rule revising the Fair Labor Standards Act (FLSA) joint employer regulation.
