{"id":637,"date":"2019-02-25T13:16:00","date_gmt":"2019-02-25T23:16:00","guid":{"rendered":"https:\/\/www.skyloft.dev\/hosted-clients\/esandalaw\/?p=637"},"modified":"2022-06-05T13:17:13","modified_gmt":"2022-06-05T23:17:13","slug":"eeoc-proposed-rule-amends-procedural-regulations","status":"publish","type":"post","link":"https:\/\/www.skyloft.dev\/hosted-clients\/esandalaw\/news-and-information\/eeoc-proposed-rule-amends-procedural-regulations\/","title":{"rendered":"EEOC Proposed Rule Amends Procedural Regulations"},"content":{"rendered":"\n<p>The Equal Employment Opportunity Commission (EEOC) has proposed a rule amending its procedural regulations including the following:<\/p>\n\n\n\n<p><strong>Digital Document Transmission<\/strong><\/p>\n\n\n\n<ul><li>Explicitly stating that all parties involved in discrimination charges filed with the EEOC may electronically transmit documents, including notices of charges, through its digital intake system piloted in 2017.<\/li><\/ul>\n\n\n\n<p><strong>Deferrals to State and Local Agencies<\/strong><\/p>\n\n\n\n<ul><li>Clarifies the filing deadline for charges filed in locations where a state or local fair employment practices agency exists but does not have \u201cjurisdiction over the statutory basis alleged in the charge\u201d; this filing deadline is 180 days.&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>Closing Communication<\/strong><\/p>\n\n\n\n<ul><li>Clarifies that:<ul><li>dismissal of a charge includes notice of the charging party\u2019s statutory right to file a lawsuit; and<\/li><li>a \u201cno-cause\u201d determination by the EEOC does not mean the claims have no merit<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>Delegation of Authority to Issue \u201cDismissal and Notice of Rights\u201d<\/strong><\/p>\n\n\n\n<ul><li>Permits EEOC district, field, area and local office directors to delegate to other EEOC employees the authority to issue dismissals<br>and<\/li><li>Permits the Commission or director of an office issuing a dismissal to reconsider that determination and to issue a notice of intent to reconsider even if the 90-day period for filing suit has already expired<\/li><\/ul>\n\n\n\n<p><strong><a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/02\/22\/2019-02664\/procedural-regulations-under-title-vii-ada-and-gina-procedures-age-discrimination-in-employment-act#p-96\" target=\"_blank\" rel=\"noreferrer noopener\">Age Discrimination in Employment Act (ADEA) charges<\/a>:<\/strong><\/p>\n\n\n\n<ul><li>The written ADEA charge \u201cneed not identify by name the person on whose behalf it is made,\u201d although the name must be disclosed to the EEOC<\/li><\/ul>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/02\/22\/2019-02664\/procedural-regulations-under-title-vii-ada-and-gina-procedures-age-discrimination-in-employment-act\" target=\"_blank\" rel=\"noreferrer noopener\">Notice of Proposed Rulemaking<\/a>&nbsp;was published on February 22, 2019 in the Federal Register; the public has 60 days (or until April 23, 2019) to offer comments.
