The combination of an administration and Congress both disorganized and at odds with each other results in highly politicized action (and inaction). ES&amp;A President\u00a0<a href=\"https:\/\/www.esandalaw.com\/staff\/anna-elento-sneed\/\"><strong>Anna Elento-Sneed<\/strong><\/a>\u00a0presented a webinar on the &#8220;2019 Employment Law Outlook: Trump Era, Volume 3,&#8221; identifying issues to watch, including:<\/p>\n\n\n\n<ul><li>National Labor Relations Board (NLRB)<ul><li>Joint employer status: The battle continues between\u00a0<em>Browning Ferris<\/em>\u00a0(2015) and\u00a0<em>Hy-Brand<\/em>\u00a0(2017). Net effect: uncertainty over the standard, and controversy over whether &#8220;issue&#8221; preclusion is an appropriate ethical standard for recusal.<\/li><li>Independent contractor test:\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.esandalaw.com\/news\/10-news\/327-nlrb-revises-independent-contractor-standard.html\" target=\"_blank\"><em>SuperShuttle<\/em>\u00a0(2019)\u00a0<\/a>supplants\u00a0<em>FedEx<\/em>\u00a0(2014).\u00a0<\/li><li>Concerted action and employee handbook cases: See\u00a0<em>Allstate Maintenance LLC<\/em>\u00a0(2019). Net effect:\u00a0Expect more unfair labor practice cases being litigated at NLRB.<\/li><li>Prosecution of unfair labor practice (ULP) cases: Board must defer processing of ULP cases to grievance and arbitration procedure. Net effect: NLRB regional directors may not interpret the new policy the way the Board does, possibly resulting in increased litigation.<\/li><\/ul><\/li><li>Equal Employment Opportunity Commission (EEOC)<ul><li>EEOC understaffed and no longer has quorum at this time<\/li><li>Promised &#8220;rollbacks&#8221; still being worked on: wellness regulations; EEO-1 reports; Title VII (note: doesn&#8217;t affect Hawaii due to Chapter 378)<\/li><li>Issues continuing to be fought in courts (including at the state level) include: transgender rights; religious discrimination; #MeToo<\/li><li>Growing interest in: use of tech in pre-screening of applications; accommodation of hearing impairments<\/li><\/ul><\/li><li>U.S. Department of Labor (USDOL)<ul><li>Leadership still shaky<\/li><li>Promised &#8220;rollbacks&#8221; still being worked on: exempt employee salary threshold; &#8220;persuader&#8221; rule; OSHA work injury reporting<\/li><\/ul><\/li><li>U.S. Supreme Court<ul><li>Class action waivers: In\u00a0<em>Epic Systems Corp.<\/em>,\u00a0<em>Murphy Oil USA<\/em>, and\u00a0<em>Ernst &amp; Youn<\/em>g, the Court ruled employers could require employees to sign class action waivers as a condition of employment. Net effect: Arbitration agreements being challenged under state contract laws.<\/li><li>Agency fees: In\u00a0<em>Janus<\/em>, the Court ruled compelling agency fees constitutes a First Amendment violation. Net effect: Increasing litigation challenging public union dues assessments; public unions re-examining their business models.\u00a0<\/li><li>Past salary history. Note:\u00a0<a href=\"https:\/\/www.esandalaw.com\/news-and-information\/hawaii-employers-what-is-your-pay-equity-picture\/\">Hawaii law now prohibits employers from considering past salary history<\/a>.\u00a0<\/li><li>Religion v. LGBT rights: Cases of interest include:\u00a0<em>Altitude Express;\u00a0Bostock<\/em>;\u00a0<em>R.G. &amp; G.R.Harris Funeral Homes<\/em>; and the continuing saga of\u00a0<em>Masterpiece Cakeshop.<\/em><\/li><li>Exhaustion of administrative remedies:\u00a0<em>Fort Bend County v. Lois M. Davis<\/em>\u00a0&#8211; can federal courts hear a workplace bias claim even if the worker didn&#8217;t first complain to the EEOC?<\/li><li><em>Chevron\/Auer<\/em>\u00a0doctrine: Should federal courts defer to government agency interpretations of its own rules?<\/li><\/ul><\/li><li>Congress\u00a0<ul><li>Tax reform: How will its full impact be felt on: corporate strategy, individual tax exemptions, benefit plans, and nonprofits and employee benefits?<\/li><li>Anticipated bills: budget; immigration; joint employer; Title VII<\/li><li>More challenges to ACA. Note: Will not affect Hawaii Prepaid Health Care Act, which has ACA exemption<\/li><\/ul><\/li><li>Hawaii Supreme Court pending case<ul><li><em>Josue v.
