{"id":641,"date":"2019-01-30T13:18:00","date_gmt":"2019-01-30T23:18:00","guid":{"rendered":"https:\/\/www.skyloft.dev\/hosted-clients\/esandalaw\/?p=641"},"modified":"2022-06-05T13:19:00","modified_gmt":"2022-06-05T23:19:00","slug":"nlrb-revises-independent-contractor-standard","status":"publish","type":"post","link":"https:\/\/www.skyloft.dev\/hosted-clients\/esandalaw\/news-and-information\/nlrb-revises-independent-contractor-standard\/","title":{"rendered":"NLRB Revises Independent Contractor Standard"},"content":{"rendered":"\n<p>On January 25, 2019, ruling in the case of&nbsp;<a href=\"https:\/\/www.nlrb.gov\/case\/16-RC-010963\" target=\"_blank\" rel=\"noreferrer noopener\">SuperShuttle DFW, Inc.<\/a>, the National Labor Relations Board (NLRB) clarified the role of \u201centrepreneurial opportunity\u201d in determining independent contractor status.<\/p>\n\n\n\n<p>As part of its legal test for employment status of the shuttle-van-driver-franchisees, the NLRB considered those factors \u2014 including ownership of vans, method of compensation, control over work schedules and working conditions \u2014 that contributed to the drivers\u2019 control over how much money they could make each month. The board ruled that the drivers had significant entrepreneurial opportunity for economic gain and as a result were considered independent contractors. This ruling overturns a 2014 case (FedEx Home Delivery) in which entrepreneurial opportunity was severely limited as a deciding factor.
